Resumen
En este artículo el autor realiza un análisis crítico y pormenorizado de la garantía del ne bis in idem a partir de la Constitución Española y su recepción en la jurisprudencia de ese país, para luego examinar las decisiones adoptadas en esa materia por el Tribunal Europeo de Derechos Humanos sobre la base del Protocolo 7 de la Convención Europea de Derechos Humanos.
Summary: In this paper, the author makes a critical and detailed analysis of the principle of double jeopardy from the Spanish Constitution and its reception in the jurisprudence of that country, and then examine the decisions taken in this matter by the European Court of Human Rights based on the Protocol 7 of the European Convention on Human Rights.
